Cannabis laws in Hawaii
Summary of Hawaii’s Medical Cannabis Law
Qualifying for the Program: To qualify for an ID card, a patient must have a qualifying condition and a statement from a Hawaii physician or an advance practice registered nurse with prescribing authority that the “potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient.” Patients then apply to the Department of Health for an ID card. Beginning in the first half of 2019, the department will launch an “electronic card” to provide patients with immediate access to medical cannabis upon approval.
Qualifying Conditions: The qualifying conditions in Hawaii are cancer, HIV/AIDS, glaucoma, PTSD, rheumatoid arthritis, lupus, epilepsy, and multiple sclerosis, and diseases causing one or more of the following: severe pain, cachexia or wasting, severe nausea, seizures, or severe and persistent muscle spasms. The health department can approve additional conditions. A minor patient only qualifies with parental consent and if the adult controls the dosage, frequency of use, and acquisition of marijuana.
Legal Protections: In addition to protections patients and medical cannabis businesses have from criminal penalties, in 2015, the legislature added some anti-discrimination protections for patients about education, housing, medical care, and child custody:
- No school is allowed to refuse enrollment to an individual solely because of that person’s status as a medical marijuana patient or caregiver.
- Landlords are prohibited from refusing rental solely because of medical marijuana enrollment status.
- However, schools and landlords that would lose a financial or licensing-related benefit under federal law or regulations if they enroll or rent a medical marijuana patient are exempt from this provision.
- The proper use of medical marijuana is no longer considered the use of an illicit substance, nor can it otherwise disqualify a patient for medical care, including organ transplants. The use of medical marijuana will be considered as the use of any other kind of medicine.
- Qualified patients and caregivers can no longer be denied custody, visitation, or parenting time with a child. In addition, status as a medical marijuana patient or caregiver, on its own, cannot lead to a presumption of neglect or abuse.
- Provisions in home-owner’s association or condominium bylaws, articles of incorporation, administrative rules, or similar documents that allow patient and caregiver discrimination are invalid. However, these types of entities may still prohibit the smoking of medical marijuana if they also prohibit tobacco smoking. In these cases, patients are still free to administer their medicine in other ways, like vaporization.
Possession and Cultivation Limits: Hawaii’s law allows a patient with a registry identification card and their caregiver to collectively possess four ounces of processed marijuana and cultivate a total of 10 plants.
Visiting Patients: PursuUnder18 law, patients registered in other medical marijuana states and their caregivers will be allowed to possess no more than four ounces of medical cannabis while visiting Hawaii. They will be required to register with Hawaii’s medical cannabis program and could do so for no more than one or two 60-day intervals in 12 months. Visiting patients may obtain cannabis from Hawaii dispensaries but not cultivate it.
Caregivers: Patients may designate a caregiver to assist patients by picking their cannabis from a dispensary. At this time, caregivers may also help with cultivating patients’ plants. Caregivers will not produce after December 31, 2023, unless there is no dispensary on the patient’s island, or the caregiver is the parent, guardian, or person having legal custody for a minor patient or an adult lacking legal capacity.
Regulated Access; Under amendments enacted in 2015, Hawaii has granted eight medical marijuana licenses to produce, manufacture, and dispense medical marijuana and manufactured marijuana products. Each licensee may have up to three cultivation locations and two dispensing locations. Hawaii’s first dispensaries began serving patients in August 2017.
Limitations: Hawaii law does not allow the medical use of cannabis if it endangers the health or well-being of another person, nor does it allow the medical use of cannabis in a bus, moving vehicle, one’s workplace, on school grounds, or in a place open to the public.
This does not prohibit patients and caregivers from transporting cannabis when it is in a sealed that is not visible to the public.
Patients and caregivers may not use butane for THC extractions from cannabis. Doing so is a Class C felony.

Good news to outdoor growers; Hawaii is probably where you want to be right now.
You can start as early as April to grow your weed.
The growing season lasts until July, which means many harvests.
However, you can also double your harvests by using fast flowering seed strains
You’ll still have enough time to grow your cannabis seeds even with the rainy seasons.
Some growers would still want to keep their weed garden indoors.
We can help with that.
When it comes to indoor growing, you create the proper condition for all the plant’s life.
It has been made simpler with the state of the art technology; even if you want to go traditional, you can.
The temperature and humidity levels, water with a PH of 6-7, the grow lights, and the fresh air must be just right.
It is said that plants from the indoors have high levels of THC content compared to the Outdoors.
If you still want an outdoor option, you can use greenhouses.
They run on less electricity than indoor grow areas.
They also facilitate giving shelter to weed crops whenever there are heavy rains.
Most Popular weed strains in Hawaii
Growing cannabis seeds in Hawaii is only for medical purposes.
If you want to be among this category you can become a caregiver to a patient with the illnesses stated in the laws or get a medical marijuana license.

Issues to consider when growing marijuana in Hawaii
In this incredible paradise, you can also encounter problems that can end your cannabis crop.
You may encounter these issues as you grow your weed; law enforcement, thieves, harsh weather, pests, and diseases.
From law enforcement to an epic deluge of rain, Hawaii is full of surprises that may catch you off guard. Here’s a list of issues that you may experience during this year’s growing season:
Even for medical marijuana patients, there are limits to your cannabis growing.
If you are found with more than the required number of plants, you will have to face the music.
You can either comply or be discreet about your cannabis planting.
You can steer the cops or your neighbors away by using carbon filters or grow-tents to help keep down that insufferable smell from your weed plants.
A great idea for outdoor growers would be to use tomato plants to camouflage your weed plants or install high fences.
Ever since cannabis was legalized in Hawaii, thieves have been on a rampage taking buds from growers.
This calls you on high alert as a cannabis cultivator in Hawaii.
Take the initiative of installing security measures in your growing areas.
Like in indoor growing areas, you can use cameras or motion detector alarms
For the Outdoors, high fences, or motion-detector floodlights.
Also, remember that the more people you tell, the more likely your weed will be stolen.
In Hawaii, the worst weather is during summer; hurricanes, scorching heat, neck-break winds.
Therefore, outdoor growers must reinvent ways to keep their cannabis plants safe.
You can set up structures that can hold through these elements.
You always have to have a standby generator for indoor growers because of disturbance from the power shortages.
Pests and Diseases
If you plan on growing your marijuana crop in Hawaii, expect to find bugs and bud rot in your garden.
This is because of the nature of its climate- plenty of humidity.
Therefore, you must have measures in place from the start; if you use pest and disease-resistant seed strains, you will not have to worry about powdery mildew or mites.
You can also apply about 2-3 times organic fungicides or pesticides on your weed plants during the vegetative phase. This will keep the pests and diseases at bay.
